On The Moon Again Contest - Win a telescope

 

Article 1: Organization
The non for profit association Uranoscope de France hereinafter referred to as "The organizer", whose head office is located at 94 rue de la Glacière 75013 Paris, organizes a free game without obligation to purchase from the 28th of May 2019 09:00 to the 10th of June 2019 at 23:59.

In this anniversary year of Man's first step on the moon, the organizer joins forces with the world event "On the Moon Again" to offer to one of the participants a chance to win an astronomical telescope that the laureate will have to use on July 12 and 13, 2019 as part of the international "On the Moon Again" event that encourages telescope owners around the world to go out on the night of July 12 to 13 to observe the moon.


Article 2: Participants
This free game without obligation to purchase is exclusively open to adults or minors, residing in France (including Corsica) and DOM-ROM or in any other country.

Minors are allowed to enter this game, provided they have previously obtained from their parents or guardian express permission to do so. Minors participation implies that they have obtained this authorization.

Are excluded from the game any persons who do not meet the above conditions, as well as the staff of "The organizer", and any person who directly or indirectly participated in the design, implementation or management of the game as well as their spouses and family members: ascendants and direct descendants or other relatives living or not living with them.

"The organizer" reserves the right to ask any participant to justify the above conditions. Anyone who does not fulfill these conditions or refuses to justify them will be excluded from the game and will not be able to benefit from his prize if he wins.

Only one entry per person (same name, same address) is allowed. "The organizer" reserves the right to carry out any verification for compliance with this rule.

Participation in the game implies full acceptance of these rules.

To participate, candidates must film themselves reading the text below by following the instructions:

Duration: about 1 minute video
Format: 16/9
Size: Maximum 200 MB
Language: English (with the exception of welcoming adress)
Composition: Face and upper body
Background: We encourage you to film yourself in front of a decor evoking Space (poster of Moon, rocket, telescope ...). You can also film yourself in front of a representative landscape of your area.

The application file must include:
- A video file named according to this model [Name-Firstname-Country]
- A file containing the information about the participant: Surname, first name, postal address, email address, date of birth, telephone number and an agreement to broadcast and edit the video for the promotion of the On The Moon event Again.

- Parental authorization (if the participant is a minor): I, the undersigned [xxx] Legal representative of [xxx] By sending this video, I agree to it being shared, edited and used to promote the On The Moon Again event.

If the files are large, please use an appropriate web service such as We Transfer (https://wetransfer.com/).

The participant must completely and correctly complete the information form to validate his registration. The player is informed and agrees that the information entered in the registration form is worthy of proof of his identity.

Any participation made contrary to the provisions of these rules will render the participation invalid. Any participant suspected of fraud may be removed from the competition by "The organizer" without it having to justify it. Any identification or participation that is incomplete, erroneous or illegible, intentionally or unintentionally, or carried out in a form other than that provided for in this Regulation will be considered void. The same sanction will apply in case of multi-participation.

 

Article 4: Prize
The endowment involved is:

• One 150mm Newton telescope on EQ3-2 motorized double axis mount. An excellent light instrument for beginners. This telescope is offered by the Clef des Etoiles

Total value: 550 € all taxes inclusive.

The value of the prize is determined at the time of writing of this by-law and can not be the subject of a dispute as to its evaluation.

All costs incurred after the game including the maintenance and use of the telescope are solely at the winner expanse.

 

Article 5: Designation of the winner
At the end of the game a draw will take place on 13th June 2019.

Condition(s) of participation in the draw:

The file must be complete (video file, participant information, authorizations). Videos must be legible (sound and image) and follow the instructions given in the rules above.

The winner of the 1st prize commits to use the telescope on the night of July 12 to 13, 2019, night of the event "On the Moon again" and to send us a photo taken during this event.

Article 6: Announcement of the winner
• The winner will be informed by e-mail at the address indicated when registering for the contest
• The winner will be announced on the contest website.

Article 7: Delivery of the lot
• The prize will be sent to the postal address indicated by the participant.
• If the telescope cannot be dispatched to the winner's country, another draw will be made.

In case of failed delivery of telescope, it will remain available to the participant for 15 days. After this time, the winner will no longer be able to claim it.

The winner agrees to accept the prize as proposed without the possibility of exchanging the prize for cash, other goods or services of any kind, or transfer of the benefit to a third person. Similarly, this prize cannot be the subject of a compensation claim.

"The organizer" reserves the right, in case of occurrence of an event beyond its control, in particular  related to its suppliers or unforeseen circumstances, to replace the advertised prize with a prize of equal value. The winner will be kept informed of any changes.

Article 8: Use of participants' personal data
Participants' information is recorded and used by "The organizer" to register their participation in the contest and to allow the prize attribution.

Participants may, for legitimate reasons, refuse the processing of their personal data in the context of this game. They also have a right of to refuse their data being used for commercial prospecting purposes, apart from participation in this competition, which they can claim as soon as their participation in the contest is registered, by sending their request by email to "The organizer" whose address is mentioned in Article 1.

The winner(s) authorize "The organizer" to use for advertising purposes or external communications any of their personal details (surname, first name), on any medium whatsoever, without this conferring them a remuneration, a right or a any advantage other than the allocation of their prize.

In accordance with the Data Protection Act and its latest version, as well as Regulation No. 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, the participant may exercise his right of access, rectification, deletion of data, limitation of treatment, his right to portability of data, his right of opposition, as well as his right to withdrawing his consent by writing to "The organizer" whose address is mentioned in Article 1.

 

Article 9: Rules of the game
The rules of the game are deposited with SELARL ACTA - PIERSON and ASSOCIATES holder of a bailiff office domiciled 15 rue de Sarre PO Box 15126 57074 METZ Cedex 3, France.

It may be sent free of charge to any person who requests it from the organizer.

"The organizer" reserves the right to extend, shorten, modify or cancel the game at any time, especially in case of force majeure, without any claim to any compensation by the participants. The amended by amendment (s), will be deposited, if necessary to SELARL ACTA - PIERSON and ASSOCIATES holder of an office of bailiff domiciled 15 rue de Sarre PO Box 15126 57074 METZ Cedex 3.

Article 10: Industrial and intellectual property
The reproduction, the representation or the exploitation of all or part of the elements composing the game, this included regulation are strictly forbidden.

All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site and on the sites to which it allows access via hypertext links, are the exclusive property of their owners and are protected as such, by the provisions of the Intellectual Property Code for the whole world. Their unauthorized reproduction constitutes an infringement punishable by criminal penalties.

Any reproduction, total or partial, unauthorized of these marks, logos and signs constitutes an infringement punishable by penal sanctions.

Participation in this game implies full acceptance of these rules by the participants.

Article 11: Liability
The responsibility of "The organizer" can not be engaged in case of force majeure or fortuitous event beyond its control.

"The organizer" can not be held responsible for delays, losses, theft, damage, or lack of readability of stamps from postal services. It also can not be held responsible and no appeal can be brought against it in case of occurrence of events of force majeure (strikes, bad weather, etc...) partially or totally depriving participants of the opportunity to participate to the game and / or the winner of the profit of his gain.

"The organizer" as well as its service providers and partners will in no way be held responsible for any incidents that may occur in the use of the endowment by the beneficiary or his guests once the winner has taken possession.

Similarly, "The organizer", as well as its service providers and partners, can not be held responsible for the loss or theft of the endowment by the beneficiary once the winner has taken possession. Any additional cost necessary to take possession of the prize is the sole responsibility of the winner, without the latter being able to claim any compensation from "the organizer", the service providers or partners.

Article 12: Litigation & Complaint
This Regulation is governed by French law.

"The organizer" reserves the right to decide without appeal any difficulty that may arise regarding the interpretation or the application of the present rules, it being understood that no contesting will be admitted in particular on the modalities of the game, on the results. , on the winnings or their receipt, one month after the end of the game. Except in case of obvious errors, it is agreed that the information resulting from the gaming systems of "The organizer" have probative force in any dispute as to the elements connection and computer processing of said game information.

Any claim must be made in the month following the end date of the game to "The organizer". After this date, no claim will be accepted. Participation in the game entails full acceptance of these rules.

 

Article 13: Evidence Agreement


By express agreement between the participant and "the organizer", the IT systems and computer files of "The oorganizer" will be used as proof.

The computerized registers, kept in the computer systems of "the organizer", under reasonable conditions of safety and reliability, are considered as proof of the relations and communications between "the organizer" and the participant.

It is therefore agreed that, except in the case of manifest error, the "Organizer" may rely, in particular for the purposes of proof of any act, omission or omission, on programs, data, files, recordings, operations and other elements (such as follow-up reports or other reports) of a kind or in computer or electronic format or medium, prepared, received or kept directly or indirectly by "the organizer", in particular in its computer systems.

The elements considered thus constitute proof and if they are produced like means of proof by "the organizer" in any contentious or other procedure, they will be admissible, valid and opposable between the parts in the same way, under the same conditions and with the same probative value as any document that would be drawn up, received or kept in writing.

Transactions of any kind made using the identifier and code assigned to a participant, following registration, are irrefutably presumed to have been carried out under the responsibility of the participant.
